Mental Health Hearings

The Office of the Public Defender handles all mental health hearings before a Luzerne County Mental Health Review Officer for involuntary commitments to inpatient mental health examination and treatment, in accordance with the Pennsylvania Mental Health Procedures Act, commonly known as Section “302, 303, 304, & 305 hearings”, and files appeals to county and state appellate Courts from these decisions. The Office also provides representation for competency issues for all persons accused of criminal or juvenile delinquency offenses, whose capacity and competency to proceed, understand and assist in their defense is in question, as well as their criminal responsibility for the charges alleged, due to their mental state and capacity at the time of the alleged offense.
