Luzerne County Probation Services, Court Collections Division is mandated to enforce the collection of all court ordered fines, costs, fees, and restitution. If restitution is not ordered by the Court, it will not be collected. The Court Collections Division does not solicit, determine, or change any court order.
All victims of crime rights in Pennsylvania; many of these rights are part of the Pennsylvania Crime Victims Act (18 P.S § 11.101) (PDF). Some rights may only be available to victims of personal injury crimes, and other rights may only exist when the crime is committed by a juvenile offender.
Claims for restitution in criminal cases must be made through the Office of the District Attorney, and in a timely manner. All claims must be submitted with the appropriate documentation and should include the complete name and address of the victim. Submitting accurate and complete victim information to the Luzerne County District Attorney’s Office prior to criminal proceedings is crucial.
Once an offender appears in Court and there is a conviction, the Court may then order restitution to be paid to a victim.
